Summer vacation is coming, how is he? Did he listen to everything I said? I don’t know if he can keep up with his studies after returning to his hometown?

I am a prosecutor in the juvenile prosecution department of the Fangshan District Procuratorate in Beijing. The child I am very concerned about, named Xiaoqiang (pseudonym), is the alleged offender of a robbery I once handled.

Xiaoqiang is the youngest child in the family, and his parents come to Beijing to work and grow vegetables for a living. Xiaoqiang went to an Internet cafe to surf the Internet during the holidays. After coming out of the Internet cafe, he felt that he had not had enough fun but he had no money. When he saw a woman passing by, he suddenly wanted to grab some money, so he hit her on the head with a branch from behind. After the victim was beaten, he began to cry for help. Xiaoqiang was afraid and turned his head to run away, but was eventually captured by the public security police.

Xiaoqiang is a minor. During the investigation stage, he hired a legal aid lawyer. With the help of the lawyer, Xiaoqiang’s mother compensated for the victim’s losses and obtained the victim’s understanding. Our hospital finally decided to make a relative decision not to prosecute Xiaoqiang based on the case. At the admonition meeting to announce the decision not to prosecute, the police, lawyers, social workers, and Xiaoqiang’s family all came to the scene. I announced the decision not to prosecute, and criticized and educated Xiaoqiang in the form of a letter from the prosecutor. Xiaoqiang said that in the future, he must study hard, live up to everyone’s help and expectations, and never do anything illegal again. After the decision not to prosecute was announced, the social worker followed Xiaoqiang for 6 months.

With a phone call from Henan, my hanging heart was relieved. On the phone, Xiaoqiang told me that he had returned to the classroom at his hometown school, living a fulfilling and happy school life like every child his age. During the summer vacation, he had to make up for his homework and make up for lost time.

Focusing on the management of Internet cafes, our hospital and the Fangshan District Cultural and Cultural Commission continued to strengthen cooperation. The District Cultural and Cultural Commission made an administrative penalty decision on the Internet cafes involved in the case in accordance with the "Regulations on the Management of Internet Access Service Business Places".

I have been a prosecutor for 33 years, and now I am a prosecutor who has not been a prosecutor, and I am also a vice principal of the rule of law. Every summer vacation, I go to various communities in this district to give lectures on the rule of law, and I have persisted for more than ten years. In order to fill the gap in children’s holiday legal education and effectively penetrate into the field of legal education for minors in the community, our hospital has also built a "legal service station for minors" in Shimenying District 5 of Mentougou District. Activities such as legal publicity, legal consultation, and parenting education have been carried out vividly. Today, this service station has become a "demonstration station of Lei Feng Volunteer Service Station for Capital Learning".

On the first day of the children’s summer vacation, I came to Zengdong Community in Dayu Street early. This summer activity was not my own action, but the launching ceremony of the "Vice Principal of Law Summer Community Classroom" was moved here in conjunction with the Youth League District Committee.

In order to do a good job in the inheritance of legal popularization work, the vice presidents of the rule of law in our hospital have been selected through layers of selection to stand out. In order to further improve the professional level of the vice presidents of the rule of law and the ability to publicize the law, we conduct level-by-level assessments through speeches, professional comments, etc. There are not only senior prosecutors handling cases on the front line, but also a group of young prosecutor assistants who graduated from Tsinghua University, Peking University, and China University of Political Science and Law with solid theoretical skills and youthful vitality.

After the launching ceremony, I led the newly elected Vice Principal of Rule of Law to give lectures on the rule of law in Zengdong Community and Huimin Home Community entitled "Happy Summer Vacation, Safe No Holiday". Guided and interactive teaching, with one movement, one quietness, one question and one answer, not only increased the fun of children’s summer Fa study, but also enriched their summer life.

After the lecture, we also distributed legal pocket books such as "Prosecutors Around" and "Learning to Protect Yourself" edited by our school to students and parents, as well as a letter to parents. Next, I will also lead the newly elected vice principals of the rule of law to various communities to carry out legal education, hoping that the children will have a happy, safe and meaningful summer vacation. As an old prosecutor, I saw the demeanor of the young vice principals of the rule of law; as the first batch of vice principals of the rule of law in our district, I saw the power of inheritance; as a mother, I saw the seriousness and smiles of the children when they studied the law. I think I am also happy this summer!

At half past nine in the evening, it was already dark, and there were bursts of children’s laughter playing downstairs and the familiar chirping of cicadas on a hot summer night. It was another summer vacation, and it was also the happiest time for children. But I couldn’t help but sigh deeply. I recalled a case I had just handled a few days ago. An innocent child had been violated during a happy summer vacation.

The children are on summer vacation, but the parents still have to work hard, which has led to some children being sent to grandparents’ houses, to childcare centers, or to "small dining tables" that can be hosted and eaten.

Little do we know that criminals may be all around us, and if we are not vigilant, we may extend our sinful "black hands" to the babies. It is essential to improve children’s self-protection awareness and ability.

One of the important functions of illegal work is crime prevention, and it is also our important duty to protect the safety of children, so we are also called "prosecutor mothers". At the beginning of this summer, I went into a community and gave a legal lecture on "self-protection" to the children in this large community who were on summer vacation, so that they could have a happy and smooth summer vacation.

The children who participated in the activity were all children in junior high school and primary school in the community, all of whom were lively and cheerful. I put forward the slogan "Strive to be a summer self-defense guard" to them, and introduced their important rights such as the right to life and health, and what kind of behavior is an illegal infringement of their rights.

In order to let the children have a personal experience, I designed 4 interactive small sessions to let the children understand the routines of "bad guys" in reality through situation performances. Several scenarios such as impersonating real-world friends, waiting for opportunities to steal and grab, and taking advantage of kindness were also set up. What makes me relieved is that the children who participated in the interaction had a strong sense of self-protection, and they were able to resolutely resist all kinds of deception proposed by "bad guys", and they could also consciously protect themselves. The children’s outstanding performance was applauded and appreciated by the parents at the event.

I told the children about real small cases that happened around them, telling them that danger may be around. By teaching the children the "tricks of self-protection", I taught the children how to learn to protect themselves and stay away from danger during the summer vacation.

"Takeaway Brother" New Beginning

Summer vacation can be said to be the most anticipated vacation for students in school. There are many activities such as travel, summer camps, and tutoring classes. But for school dropouts, summer vacation seems to have lost its meaning, but this summer vacation is of great significance to Xiao Lang (a pseudonym). During the summer return visit, Xiao Lang said to me: "When I got the decision not to prosecute and walked out of the door of the procuratorate, I felt very relaxed."

Worried and taciturn were my first impressions of Xiao Lang. It was in October 2017 that I first met Xiao Lang, a 17-year-old boy who was transferred to our hospital for investigation and prosecution on suspicion of buying and selling identity documents. His mother accompanied him. Throughout the process, Xiao Lang looked solemn, often playing with his fingers with his head down, and kept repeating the sentence "I just want to deliver a few more takeaways on my motorcycle." Xiao Lang’s mother was also very perturbed and kept asking what the final outcome of this case would be. Under our constant comfort and guidance, Xiao Lang’s situation gradually became clear.

Xiao Lang dropped out of school to work in Beijing due to his poor family and found a job as a food delivery worker. After a few days of delivering food by riding an electric car, he found that the motorcycle had good maneuverability, high speed, low fuel consumption, and low food delivery costs, which could save a lot of money compared to riding an electric car. However, Xiao Lang was under the age of 18 at the time, and according to regulations, minors could not obtain a motor vehicle driver’s license, so they could not drive a motorcycle to deliver food. But in order to reduce the pressure of his mother’s cleaning work to subsidize the family, Xiao Lang still chose to take the risk. He bought second-hand motorcycles and fake driving licenses, driver’s licenses, license plates and other documents through second-hand online shopping, and began to ride motorcycles to deliver food. Last July, Xiao Lang was caught riding the motorcycle to deliver food and was subject to administrative punishment. In September, he was seized by the public security police for riding the motorcycle to deliver food. The public security organ transferred Xiao Lang to our hospital for review and prosecution on suspicion of buying and selling identity documents.

After understanding the case, I patiently explained the case to Xiao Lang. He quickly realized his mistake. In view of his good attitude of confession and repentance, the purchase and use of a false driver’s license was necessary for food delivery, and the social harm was relatively small. At the end of last year, our hospital made a conditional non-prosecution decision against Xiao Lang according to law, with a 6-month inspection period.

I have kept in touch with Xiao Lang and his parents, kept up with Xiao Lang’s current situation, and regularly helped Xiao Lang with the social worker. One day in March this year, during the conditional non-prosecution period, Xiao Lang called to tell me that he had successfully obtained a motorcycle driver’s license. Hearing the excited voice on the other end of the phone, I was also sincerely happy for him.

As an unprosecuted prosecutor, I am responsible for the work of the "arrest, prosecution, supervision and prevention" system. In addition to handling the case itself, I should also jump out of the case and think about what else I can do. It is through the guidance and help of delinquent juveniles in case handling practice that I have a deeper understanding of the "education, probation, rescue" policy, "education first, and punishment second" principle.

Send the teenager home

Another year of summer vacation arrived. Looking through the desk calendar, I suddenly found that the boy who stole the electric car, Xiaoyu (a pseudonym), was about to receive his 8-month sentence. July 15 was the day he was released from prison.

From taking over Xiaoyu’s case to the final prosecution, I have poured a lot of effort into him, and he has great trust in me. However, he has no relatives in Beijing. What should I do after he is released? If I want to go home, I will definitely have no money, and if I stay in Beijing, I will not have the skills to make a living. Thinking of this, I decided to visit him and send him home.

Time to go back to the beginning of the case. This was a serial theft of electric vehicles and motorcycles. The gang of criminals was a group of young people, all from a poor mountainous area. They were instigated by fellow villagers "Brother Wang" and were tricked into coming to Beijing to "find a way to survive". "Brother Wang" taught the children how to unlock and steal electric bicycles. After selling the stolen goods, he collected all the stolen money by himself, and only gave the children barely enough money to fill their stomachs. After several lucky successes, Xiaoyu and others were arrested in Shijingshan District. By this time, he had accumulated 10,000 yuan worth of property.

During the review process, I found that the ID number and name reported by Xiaoyu did not match. It turned out that Xiaoyu had been a "black household" since birth and did not have her own ID card. In order to find out Xiaoyu’s exact identity, and to gain a deeper understanding of Xiaoyu’s living environment and growth experience, I came to Xiaoyu’s hometown with the public security officers.

The local police station environment is very simple. There is only one table in the whole office. My clerk had to lie on the motorcycle to take notes to verify Xiaoyu’s identity. Looking at these scenes, I feel sorry for these children who were used outside and committed crimes from the bottom of my heart.

After returning to Beijing, our court prosecuted Xiaoyu according to law, and he was eventually sentenced to eight months in prison by the court.

On July 15, the day of Xiaoyu’s release, the Juvenile Division of the Joint Court of our hospital and the public security department launched the "Send Xiaoyu Home" joint rescue activity. Before parting, I once again instructed Xiaoyu: "After returning home, you must learn a skill well and create a happy life with your own hands." Xiaoyu bowed deeply to me and the judge and embarked on a new journey of life.

As a prosecutor in a non-prosecution department, reviewing the facts of the case and grasping the evidence in the whole case is only the beginning of the work. Minors are fragile and vulnerable, ignorant and easily deceived, extreme and soft and easily influenced. Because of this, we also need to understand the growth experience and personality characteristics of minors, help them get out of mistakes, rebuild confidence, and become useful talents in society.

Receive an offer of admission

Just before summer came this year, I received this text message: "Sister, I have been admitted to a 211 university!"

Although the text message is simple, I can feel the joy revealed on the other end of the mobile phone through the screen. In fact, who would have thought that the teenager with excellent results who sent the text message is not my relative or friend, but an alleged offender who was once conditionally not prosecuted by our hospital. His suspected crime is drug-related crimes.

Four years ago, when this drug trafficking case was on my desk, I flipped through the case file: the facts of the case are clear and the evidence is solid. But when it comes to minors, conditional non-prosecution in different places, criminal record sealing, etc., things are complicated. I have been following this case for four years.

I still remember the first time I met him and his mother and brother. I was still a little worried that it would not be easy to communicate with them, but seeing their sincerity, I was moved. The teenager made mistakes, and his mother did not give up. She always encouraged him, exhorted him to cherish the opportunity, actively rehabilitated, and contacted the school to welcome him back to study.

Considering the situation of cracking down on drug crimes, our hospital is still very cautious about whether the juvenile can be conditionally not prosecuted. To this end, our hospital held a hearing and invited the undertaker of the public security organ, the family of the juvenile, the protector of minors, and the deputies of the National People’s Congress to discuss together. Everyone believes that the punishment of minors should be based on the growth and rescue of minors involved in the crime.

The local prosecutor in the teenager’s hometown who assisted us in our investigation and education, she routinely talked to the teenager every month and paid home visits. I still remember that in the conversation records she wrote, the teenager once called me and the local prosecutor sister. I believe it was because we really considered him, respected him, cared for him, and helped him that the child developed a sibling-like trust in the prosecutor.

With the joint efforts of all parties, the 17-year-old returned to the third year of junior high school. The 6-month inspection period was quickly passed, and the case was finally not prosecuted according to law. We have been in touch since then, and we have heard good news from him from time to time. He passed the art specialty exam and was admitted to a key high school.

From a teenager who went astray to a college student today, I believe he will have a better life in the future. I am happy to be able to participate in this process and witness his growth.
